SWIFTASK TECHNOLOGY SAS places major importance on protecting your data. This policy details how we process personal data as a Data Controller (for our customers) and as a data processor (for data hosted on the SaaS).

Account & billing data: name, professional email, payment information (Stripe).

SaaS & AI Data: "Prompts", documents, and histories submitted to the platform.

Data from "Skills" (Connectors): When you equip your AI Agents with "Skills" to interact with your own software (e.g., CRM, ERP, internal databases), Swiftask temporarily processes the data extracted/sent to execute your Prompt. To ensure connection with some of these tools, data may transit securely through our technical orchestration subcontractor (Pipedream).

Marketing Data: Browsing information, B2B prospecting data (Lusha, Linked Helper).

To provide quality service, we use leading technical providers:

Infrastructure: Scaleway (France/EU), AWS Amplify (EU).

Payment, Sales & CRM: Stripe, Odoo, Calendly.

Marketing & Support: Brevo, Lemlist, Featurebase, Prismic.

AI Model Providers (Enterprise API): OpenAI, Anthropic, Mistral AI, Google, Perplexity, xAI, AI21 Labs, ElevenLabs, AssemblyAI.

AI Orchestration & Connectors (Skills): AWS Bedrock, Replicate, Pipedream (used as orchestration infrastructure to operate some of our connectors to your third-party tools).

Note regarding "Skills": The final tools to which you connect your AI agents (e.g., your own CRM) are not Swiftask subcontractors. They are services you control. However, the orchestration service (Pipedream) used by Swiftask to establish this connection is indeed our subcontractor, subject to our strict security and confidentiality obligations.

Some subcontractors host data outside the EU (e.g., United States). These transfers are governed by the Data Privacy Framework (DPF) or by standard contractual clauses (SCC).


SaaS accounts: retained for the duration of the contract, then deleted 3 years after inactivity.

Billing data: 10 years (legal obligation).

Prompts and workspace: Retained until manual deletion by the User.

Legal notice

This DPA is an integral part of the agreement entered into between SWIFTASK TECHNOLOGY SAS (the "Processor") and the client (the "Data Controller").

In accordance with the GDPR, the Client guarantees that it processes personal Data lawfully. Swiftask undertakes to process this data only on documented instructions from the client (use of the Platform, Prompts, Skills).

Swiftask formally prohibits itself from using the client's personal data (including prompts and unstructured documents) to train its own Artificial Intelligence models or those of its AI model providers (Foundation Models).


The client authorizes Swiftask to use the sub-processors listed in our privacy policy. Swiftask will inform the client at least fifteen (15) days before adding a new sub-processor.


Swiftask implements appropriate technical measures (encryption). In the event of a data breach, Swiftask will inform the Client as soon as possible. The Client has the right to a documentary audit (maximum once per year, with 30 days' notice, at the Client's expense).


Upon termination, the client has 30 days to export their data before deletion. Any claim under this DPA is subject to the limitations and liability caps stipulated in the general terms and conditions of sale and use.

Data processing agreement (DPA)

These terms and conditions, together with any purchase order or online subscription (collectively, the "Agreement"), govern access to and use of the Swiftask.ai platform between the Client (or "you") and SWIFTASK TECHNOLOGY SAS ("Swiftask", "us"). By creating an account or subscribing to a subscription, the Client unconditionally accepts this Agreement. The services are exclusively reserved for professionals (B2B).

AI Agent: personalized virtual assistant, configured by the client to perform specific tasks.

Client: the professional legal entity subscribing to the services.

Client data: all data (documents, texts, prompts) submitted by the client in the services.

Workspace: isolated section of the service where the client's users collaborate.

Input (Prompt) / Output: Instructions submitted to the AI (Input) and the content generated in return (Output).

Skills: functionalities allowing AI agents to interact with software, business applications (e.g., CRM, ERP, databases) or external third-party services via APIs.

User: any natural person authorized by the client to access their workspace.

Swiftask provides a SaaS platform for creating and using AI Agents. The platform aggregates multiple AI models and allows the client to connect their own data sources and business tools via "Skills".

2.1. License. Swiftask grants the client a non-exclusive and limited right of access to the Services for their internal professional needs.


2.2. Restrictions. The client agrees not to: (i) resell the Service; (ii) reverse engineer; (iii) share credentials; (iv) use AI to generate illegal content, malware, or bypass security filters.

2.3. AI Agents and Skills. The client is solely responsible for configuring "Skills" and providing the necessary credentials (API keys) to connect their own tools. Swiftask disclaims any responsibility for the availability or security of these third-party services. If an output generated by an AI agent results in data modification in a client's third-party business application via a Skill, the client assumes full responsibility.

3.1. Swiftask ownership. Swiftask retains all rights to the platform, its code, and its interface.

3.2. Client Ownership. The client retains all rights to their Inputs. Subject to compliance with this agreement, the client owns the generated content (Outputs).


4.1. Fees. Subscriptions are billed according to the rates in effect on our website: https://www.swiftask.ai/pricing. Prices are exclusive of taxes. 

4.2. Payment. Payment is made in advance, via stripe or SEPA direct debit. The subscription renews automatically.

4.3. Payment Default. Any delay may result in suspension of access to the services and the application of late payment penalties (3 times the legal interest rate).


5. Warranties and limitations of liability

5.1. AI Disclaimer. The client acknowledges that AI is probabilistic. Swiftask does not guarantee the accuracy of outputs ("hallucination" phenomenon). The client must verify outputs before use.

5.2. Liability Cap. Except in cases of fraud or gross negligence, Swiftask's total liability arising from this agreement shall not exceed 100% of the total amount of fees paid by the client during the twelve (12) months preceding the event. Swiftask disclaims any liability for indirect damages (data loss, loss of revenue), including those originating from third-party services connected via "Skills".

5.3. Shortened Limitation period. In accordance with Article 2254 of the french civil code, the parties agree that any legal action arising from this Agreement must be initiated within a maximum period of one (1) year from the event giving rise to the dispute, failing which it shall be time-barred.

The processing of personal data is governed by our privacy policy and our data processing agreement (DPA). Specific conditions relating to AI are defined in our AI models annex.

This Agreement is governed by French law. Any dispute shall fall under the exclusive jurisdiction of the commercial court of nantes.

7.1. Commercial Reference. Unless explicitly refused by the client in writing, Swiftask is expressly authorized to cite the client's name and use their logo as a commercial reference on its website and communication materials.

1. Data processing and "zero data retention"


1.1. Training prohibition: Swiftask and its AI model providers (OpenAI, Anthropic, Mistral, Google, etc.) are strictly prohibited from using the Client's Data (Inputs/Outputs) to train or improve their foundation models. 

1.2. "zero data retention" (ZDR) policy: Swiftask uses the commercial ("Enterprise") APIs of its Providers. The Client's prompts and outputs are not retained by these third parties, are not used for learning, and are not subject to any human review by them.


The Client is expressly prohibited from using Swiftask to:

Develop competing AI models (use of outputs for model training).

Generate content intended to deceive, manipulate, or produce unsolicited mail (Spam).

Attempt to bypass security filters (Prompt Injection). The client undertakes to comply with the applicable usage policies of each AI provider they choose to activate via the Platform.


AI systems are probabilistic and may generate incorrect information ("hallucinations"). Use of these services is at the Client's risk, who has the obligation to verify independently and humanly the accuracy of Outputs before using them.
